Unlike standard cloud storage networks or public social media platforms, Legacy Everhart claims zero ownership, licensing rights, or structural claims over your recorded vocal assets, personal oral history, or narrative essence (collectively, "Archival Content"). 100% legal, intellectual, and digital ownership remains explicitly and permanently with you and your legally designated heirs.

2. The Everlasting App Subscription Tiers & Pricing

To secure sovereign, private processing free from restrictive marketplace taxes, subscriptions are established directly via our secure native web checkout infrastructure. Upon successful registration and payment, the platform is instantly active, allowing you to download the app and immediately begin recording.

2.1 The Individual Sanctuary Tier (Active Launch Tier)

Includes private standalone access to the baseline voice preservation architecture within the Everlasting App, backed by dual-layer secure redundant architecture.

• Monthly Recording Limit: Maximum of five (5) hours of fresh vocal recording time per month.
• Non-Rollover Mandate: Unused hours do not carry over. Account balance resets to exactly five (5) hours at the start of each fresh billing cycle.

2.2 The Inner Circle Path

Allows multiple family stories, generational narratives, and ancestral lines to seamlessly intertwine, backed by triple global redundancy storage. Supports up to four (4) authorized users. Annual billing offers the lowest effective rate.

• Monthly Recording Limit: Maximum of ten (10) hours of fresh vocal recording time per month, shared across all four authorized users.
• Non-Rollover Mandate: Unused hours do not carry over. Account balance resets to exactly ten (10) hours at the start of each new month.

2.3 The Grace Path (Time-Sensitive Bedside Pathway)

Built specifically for the hospital bedside, the hospice care environment, and final quiet moments where time is no longer a luxury. Features a sacred, time-sensitive recording protocol providing up to ten (10) hours of high-fidelity vocal preservation time each month for a fixed 24-month runway. Zero Friction Deployment — the path initializes instantly post-checkout.

• Post-Runway Active Extension (Living Continuity): Upon the expiration of the initial 24-month runway, if the Archivist is living beyond the two-year mark and wishes to maintain active recording privileges to continue adding new chapters to their legacy, they may do so at a flat rate of $99.99/year, which maintains their active monthly recording allocations under the Grace Path framework.
• Post-Runway Listen-Only Maintenance (Deceased Continuity): Once the Archivist is deceased, ongoing maintenance of the digital sanctuary shifts to a fixed fee of $59.99/year. This annual maintenance fee ensures the vault is kept active on the platform in a secure, permanent listen-only Preservation State, protecting the family's ongoing access to listen to the preserved legacy for generations to come.

2.4 Cancellation & Account Deletion

Canceling your subscription stops future billing, but your account and vault remain active through the end of your current paid term. For example, if the Archivist cancels six (6) months into an annual plan, the account remains fully active — with recordings accessible — for the remainder of that paid year.

Should the Archivist choose to delete their account entirely, the following parameters apply:

• Permanent Removal: All recordings and data will be permanently removed.
• Pre-Deletion Purchase Window: Before deletion is finalized, the Archivist has the opportunity to purchase a Master Archive Release.
• Base Pricing: The Master Archive Release is priced at $29.99, covering up to 10 GB of data.
• Additional Storage: Additional storage beyond the base allocation is billed at $9.99 per extra 5 GB.
• Final Opportunity: This is the only way to retain a copy of your recordings after account deletion — once deletion is complete, no cached or archived copies will remain.
• In-App Management: Both cancellation and account deletion are managed directly within the app.

2.4.1 Gifted Trial Expiration & Cold Storage Protection

Notwithstanding Section 2.4, should a gifted 30-day sanctuary trial expire without transitioning into an active paid subscription, the Company will not execute an immediate purge. Instead, user files are automatically and securely transferred to encrypted Cold Storage for a protective window of ninety (90) days to allow for retrieval or subscription activation.

• Retrieval Option: During this 90-day window, the user may choose to permanently secure and download their Master Archive file for a one-time delivery fee of $29.99.
• Final Purge: After exactly ninety (90) days, any unretrieved or unactivated data is completely and permanently purged from our ecosystem to maintain strict privacy standards.

3. The Guardian Shield™ Protection Plan

3.1 Automatic Continuity Guarantee

To safeguard against the unpredictable interruptions of life, active sanctuaries are bound by the Guardian Shield™ Protection protocol. This is an automatic, built-in continuity guarantee included natively within your subscription at no additional cost.

3.2 Involuntary Billing Failure & Grace State

In the event that an automated subscription renewal payment fails, the backend architecture automatically triggers "Preservation Mode" to isolate and protect your vault:

• Data Freeze: All existing user audio recordings remain securely stored, completely untouched, and hermetically sealed in the cloud vault. No data will be deleted during this window.
• Feature Pause: The app temporarily restricts the user's ability to record new entries and pauses active sharing extensions until billing parameters are corrected.
• 60-Day Grace Period and Vault Purge: This protected preservation state remains active for exactly sixty (60) days. During this window, multiple notifications will be sent to both the account holder and the designated successor. If the subscription is not renewed by the conclusion of the 60-day period, the account and all stored vault assets will be permanently and irreversibly deleted.

5. The Policy of Presence & Successor Card Mechanics

5.1 Appointing Your Legacy Steward

The Service acts as a digital relay race. Within the Everlasting App settings, you designate a trusted individual (the "Legacy Steward" or "Successor") to assume administrative control of your archive when the baton is passed.

5.2 The Stewardship Successor Card

The system dynamically generates a localized, prestigious Stewardship Successor Card asset stored securely within your menu partition. Account owners retain sole executive control to manually share this credential block via native device sharing extensions (text message, email, or local printing) once designation parameters are satisfied.

6. Limitation of Liability and General Terms

6.1 Service Continuity Disclaimer

While Legacy Everhart employs advanced security, dual global redundancy, and evergreen format migration, the Service is an archival vault, not a public backup utility. Legacy Everhart is not liable for data loss occurring due to user credential compromise, negligence, or the unauthorized physical sharing/loss of your secure access parameters.

6.2 Intrafamily and Successor Disputes

Legacy Everhart operates strictly as a neutral digital vault infrastructure. The Archivist assumes sole legal liability for the selection and assignment of their designated Successor. In the event of competing claims, family disputes, or estate litigation regarding access to the Archival Content, the Company will freeze the account until legally resolved and shall be held entirely harmless. The Archivist's estate agrees to indemnify, defend, and hold harmless Legacy Everhart and the Walden Apex Group from any third-party legal claims resulting from the lawful release of data.

6.3 Governing Law and Venue

This Agreement, the operational frameworks of the Walden Apex Protocol, and any disputes arising from your use of the Service shall be governed strictly by, and construed in accordance with, the laws of the State of Florida. Any legal action must be instituted exclusively in the state or federal courts located in the State of Florida.
