1.2 Strict No-AI Platform Core Mandate

Legacy Everhart operates under a permanent, unalterable technological covenant regarding user data:

• No Voice Cloning: We strictly refuse to manufacture synthetic memories, construct deepfakes, or clone your voice.
• No Algorithmic Training: Your Archival Content and vocal records will never be indexed, crawled, or scanned to train external large language models (LLMs) or artificial intelligence algorithms.
• The Raw Timbre: We preserve only the raw, unfiltered timbre of your actual human presence—never a machine's synthetic replication.
• Development Clarification: For the avoidance of doubt, this mandate applies strictly to user audio data, metadata, and recordings. The Company reserves the right to utilize advanced artificial intelligence and automated tools for backend software engineering, platform development, optimization, and digital infrastructure security.

1.3 Data Dignity Commitment

Your data is private, protected, and hermetically sealed. Legacy Everhart will never sell, mine, monetize, or lease your personal identity data or Archival Content to third-party data brokers, advertisers, or corporate entities.

2. The Everlasting App Subscription Tiers & Pricing

To secure sovereign, private processing free from restrictive marketplace taxes, subscriptions are established directly via our secure native web checkout infrastructure. Upon successful registration and payment, the platform is instantly active, allowing you to download the app and immediately begin recording.

2.1 The Individual Sanctuary Tier (Active Launch Tier)

Includes private standalone access to the baseline voice preservation architecture within the Everlasting App, backed by dual-layer secure redundant architecture.

• Monthly Recording Limit: Maximum of five (5) hours of fresh vocal recording time per month.
• Non-Rollover Mandate: Unused hours do not carry over. Account balance resets to exactly five (5) hours at the start of each fresh billing cycle.

2.2 The Inner Circle Path (Deferred Gateway Tier)

Allows multiple family stories, generational narratives, and ancestral lines to seamlessly intertwine, backed by triple global redundancy storage. Supports up to four (4) authorized users.

2.3 The Grace Path (Time-Sensitive Bedside Pathway)

Built specifically for the hospital bedside, the hospice care environment, and final quiet moments where time is no longer a luxury. Features a sacred, time-sensitive recording protocol providing up to ten (10) hours of high-fidelity vocal preservation time each month for a fixed 24-month runway. • Post-Runway Active Extension (Living Continuity): Upon the expiration of the initial 24-month runway, if the Archivist is living beyond the two-year mark and wishes to maintain active recording privileges to continue adding new chapters to their legacy, they may do so at a flat rate of $99.99/year, which maintains their active monthly recording allocations under the Grace Path framework.
• Post-Runway Listen-Only Maintenance (Deceased Continuity): Once the Archivist is deceased, ongoing maintenance of the digital sanctuary shifts to a fixed fee of $59.99/year. 2.4 Account Cancellation & Complete Data Purge

You may cancel your ongoing subscription at any time natively within the secure account settings of the Everlasting App. Because your payment lifecycle is managed through secure in-app subscription architectures, cancellation parameters must be initiated directly inside the application interface. Upon user-initiated final cancellation and account deletion, the system triggers an immediate, absolute, irreversible cloud-wide purge. The backend routine programmatically erases all relational data rows and permanently destroys all raw vocal assets and media files across all cloud systems and redundant storage networks. No cached or archived copies will remain.

2.4.1 Gifted Trial Expiration & Cold Storage Protection

Notwithstanding Section 2.4, should a gifted 30-day sanctuary trial expire without transitioning into an active paid subscription, the Company will not execute an immediate purge. Instead, user files are automatically and securely transferred to encrypted Cold Storage for a protective window of ninety (90) days to allow for retrieval or subscription activation.

• Retrieval Option: During this 90-day window, the user may choose to permanently secure and download their Master Archive file for a one-time delivery fee of $29.99.
• Final Purge: After exactly ninety (90) days, any unretrieved or unactivated data is completely and permanently purged from our ecosystem to maintain strict privacy standards.

5.1 Appointing Your Legacy Steward

The Service acts as a digital relay race. Within the Everlasting App settings, you designate a trusted individual (the "Legacy Steward" or "Successor") to assume administrative control of your archive when the baton is passed.

5.2 The Stewardship Successor Card

The system dynamically generates a localized, prestigious Stewardship Successor Card asset stored securely within your menu partition. Account owners retain sole executive control to manually share this credential block via native device sharing extensions (text message, email, or local printing) once designation parameters are satisfied.

6. Limitation of Liability and General Terms

6.1 Service Continuity Disclaimer

While Legacy Everhart employs advanced security, dual global redundancy, and evergreen format migration, the Service is an archival vault, not a public backup utility. Legacy Everhart is not liable for data loss occurring due to user credential compromise, negligence, or the unauthorized physical sharing/loss of your secure access parameters.

6.2 Intrafamily and Successor Disputes

Legacy Everhart operates strictly as a neutral digital vault infrastructure. The Archivist assumes sole legal liability for the selection and assignment of their designated Successor. In the event of competing claims, family disputes, or estate litigation regarding access to the Archival Content, the Company will freeze the account until legally resolved and shall be held entirely harmless. The Archivist's estate agrees to indemnify, defend, and hold harmless Legacy Everhart and the Walden Apex Group from any third-party legal claims resulting from the lawful release of data.

6.3 Governing Law and Venue

This Agreement, the operational frameworks of the Walden Apex Protocol, and any disputes arising from your use of the Service shall be governed strictly by, and construed in accordance with, the laws of the State of Florida. Any legal action must be instituted exclusively in the state or federal courts located in the State of Florida.

7. Privacy Policy & Sovereign Data Directive

7.1 Minimalist Data Collection Mandate

We refuse to track your digital footprint. We only collect the foundational data points strictly necessary to initialize and maintain your digital sanctuary: Account credentials (name, verified email, and date of birth storage parameters), encrypted billing tokens processed via native web billing infrastructure, and raw human audio assets intentionally submitted by the Archivist.

7.2 Explicit Data Exclusions

Our software completely blocks, strips, and excludes telemetry tracking structures:

• We do not track your physical location, browser history, or device hardware networks.
• We do not run biometric vector analysis, facial recognition tracking, or vocal printing algorithms to link your biology to external tracking databases.
• The Everlasting App contains zero advertising software development kits (SDKs), third-party data broker tracking pixels, or cross-platform analytics cookies.

7.3 Permanent Declusion From Voice Replication Pipelines

Your voice belongs exclusively to your bloodline and history. All user voice recordings, conversational assets, and profile data are completely excluded from any artificial intelligence voice training pipeline. Your audio files are physically sequestered on storage layers that reject automated web crawling and cannot be ingested by corporate LLMs, text-to-speech (TTS) frameworks, or synthetic voice generation engines.

7.4 Zero Data Sale Protection

Legacy Everhart will never sell, lease, trade, or share your personal information or Archival Content with any third party for commercial gain, marketing, or corporate monetization.
