This Privacy Policy (the "Policy") explains how Legacy Everhart (the "Service," "Platform," or "Company") collects, uses, protects, and — critically — refuses to use the personal data and Archival Content belonging to the individual initializing a digital sanctuary ("User," "You," or "Archivist").

1. Data We Collect

1.1 Minimalist Data Collection Mandate

We refuse to track your digital footprint. We only collect the foundational data points strictly necessary to initialize and maintain your digital sanctuary:

  • Account Credentials: Name, verified email, and date of birth storage parameters.
  • Billing Tokens: Encrypted billing tokens processed via native web billing infrastructure.
  • Archival Content: Raw human audio assets intentionally submitted by the Archivist.

1.2 Ownership of Submitted Content

Legacy Everhart claims zero ownership, licensing rights, or structural claims over your recorded vocal assets, personal oral history, or narrative essence (collectively, "Archival Content"). 100% legal, intellectual, and digital ownership remains explicitly and permanently with you and your legally designated heirs.


2. What We Do Not Collect

Our software completely blocks, strips, and excludes telemetry tracking structures:

  • We do not track your physical location, browser history, or device hardware networks.
  • We do not run biometric vector analysis, facial recognition tracking, or vocal printing algorithms to link your biology to external tracking databases.
  • The Everlasting App contains zero advertising software development kits (SDKs), third-party data broker tracking pixels, or cross-platform analytics cookies.

3. How We Use & Handle Your Data

3.1 Data Dignity Commitment

Your data is private, protected, and hermetically sealed. Legacy Everhart will never sell, mine, monetize, or lease your personal identity data or Archival Content to third-party data brokers, advertisers, or corporate entities.

3.2 Limited Purpose of Processing

Data is exclusively disclosed or processed to execute the blind server-side processing scripts necessary for format compression and the secure, authorized delivery of data to your verified successor. No other internal or third-party use is permitted.

3.3 Account Deletion & Data Purge

You can delete your account at any time directly within the app. Navigate to your Profile page and select the Delete Account button. Upon user-initiated account deletion, the system triggers an immediate, absolute, irreversible cloud-wide purge. The backend routine programmatically erases all relational data rows and permanently destroys all raw vocal assets and media files across all cloud systems and redundant storage networks. No cached or archived copies will remain.

Exception: If a gifted 30-day sanctuary trial expires without transitioning into an active paid subscription, files are moved to encrypted Cold Storage for a 90-day protective window before final purge, rather than being deleted immediately.


4. The No-AI Training Commitment

Legacy Everhart operates under a permanent, unalterable technological covenant regarding user data:

  • No Voice Cloning: We strictly refuse to manufacture synthetic memories, construct deepfakes, or clone your voice.
  • No Algorithmic Training: Your Archival Content and vocal records will never be indexed, crawled, or scanned to train external large language models (LLMs) or artificial intelligence algorithms.
  • The Raw Timbre: We preserve only the raw, unfiltered timbre of your actual human presence, never a machine's synthetic replication.
  • Permanent Exclusion: Your voice belongs exclusively to your bloodline and history. All user voice recordings, conversational assets, and profile data are completely excluded from any artificial intelligence voice training pipeline. Your audio files are physically sequestered on storage layers that reject automated web crawling and cannot be ingested by corporate LLMs, text-to-speech (TTS) frameworks, or synthetic voice generation engines.
  • Development Clarification: For the avoidance of doubt, this mandate applies strictly to user audio data, metadata, and recordings. The Company reserves the right to utilize advanced artificial intelligence and automated tools for backend software engineering, platform development, optimization, and digital infrastructure security — never on user Archival Content itself.

5. Data Security

All vocal and media assets are secured using High-Entropy, Quantum-Resistant encryption structures under the Walden Apex Protocol. This architecture is explicitly designed to withstand the evolution of computational decrypting power over multi-generational spans.

Your preserved voice is distributed across geographically diverse, isolated server networks, utilizing secure, redundant cloud infrastructure to ensure ironclad, generational storage redundancy against localized infrastructure disasters.


6. Zero Data Sale Protection

Legacy Everhart will never sell, lease, trade, or share your personal information or Archival Content with any third party for commercial gain, marketing, or corporate monetization.
